Booking Terms & Conditions

Thank you for traveling with LuxNomad Travels, LLC (LNT). As used in this policy, “we,” “us,” “our”, and “LNT”, means LuxNomad Travels LLC, and “you”, “your”, and “guest” means the customer, buyer, and/or consumer. The following terms and conditions “Terms” refer to all travel products and services acquired. Please review these terms carefully as it contains essential information about your LNT experience. By purchasing any travel product or service with LNT you are bound by the terms established in this agreement.

Our company continually changes, as do our policies and any rules and regulations posted on the site. We may or may contact you with periodic reminders of changes to our policies. It is your obligation to check the site frequently to see if there are any recent changes to any of our policies. LNT reserves the right to revise these terms and conditions at any time without providing notice to guests. Your continued use of the site or the services shall be deemed an irrevocable acceptance of any such revisions.

Booking

By purchasing any product with LuxNomad Travels, and/or by traveling on an LNT trip you acknowledge that you have read, understood, and agree to these Terms, and indicate your express acceptance of and agree to be bound by these Terms.  Reservations are not confirmed unless the deposit is made and the registration form has been completed.

Form of Payment
We accept all major credit cards: Visa, Mastercard, American Express, and Discover. A credit or debit card should be in your name. LNT only accepts United Stated Dollars.
Eligibility

To participate in any LuxNomad Travels experiences, guests must be 21 years of age or older.

Solo Traveler
If you are traveling with us solo and elect for double occupancy, you will be paired with another LuxNomad Travels member based on your preferences. All rooms are single-gendered unless preferenced. You will be matched with a roommate once you have paid more than 50% of the balance of your travel reservations and will then be provided the contact information of the person you will be matched with. Please note, that if 90 days before your trip, you do not have a roommate, you will be required to pay the single occupancy supplement. Payment of the single occupancy supplement can be paid in even payments and due within 45 days of departure.
Trip Protection

Travel protection is recommended but not required to participate in an LNT experience. LNT recognizes the important need to protect your trip investment, health, and personal belongings while traveling. Airlines and Resorts charge fees for trips canceled for reasons beyond your control – no matter what the reason is (weather, aircraft issues, loss of employment, health or family issues, etc.). If you choose not to purchase travel insurance/trip protections, LNT will not be responsible for penalties or fees should you cancel. We’ve partnered with Safety Wing to offer an affordable option. 

Rates and Reservation

Rates are per person, double occupancy unless you’ve opted for a single-occupancy accommodation. The current price relevant to the trip or experience will be provided to the guest at the time of booking. Foreign currency is subject to fluctuation in exchange rates and credit card issue feeds. LNT is not responsible for any increases due to fuel surcharges, government-imposed taxes/fees, or supplier-imposed increases. After booking, if it is necessary to levy an additional surcharge, LuxNomad Travels reserves the right to do so, and notification will be given at the time of final invoicing and prior to departure.

Rates are guaranteed at the time that the deposit is received by LuxNomad Travels. Until such time, rates are subject to change. The rates do not include air travel and fees, visas, required travel insurance, driver, customary gratuities, local guides, and any incidental charges. Trip Flexibility​

LuxNomad Travels reserves the right to cancel or change any trip due to inadequate enrollment or other cause that makes the trip unfeasible for us to operate. We will inform you at least 45 days prior to departure if a trip is canceled.

The itineraries and experiences presented on the website are subject to modification.` Every reasonable effort will be made to operate as planned, but alterations may still occur after final itineraries are sent. Although the itinerary has been curated with care and details are provided in good faith, LuxNomad Travels may make improvements that originate from local factors, research, reviews, weather changes, etc.

Trip Payment and Payment Plan

Each trip and destination is specially curated and therefore offers a unique payment plan. If you are unable to pay the full amount upfront, monthly payments are available. Just secure your trip with your down payment and then the remaining payments start the following month. Payment plans are not available sixty (60) days or less from the trip departure date.

Missed Payment

Monthly payments: LNT allows one missed monthly payment. You will need to make two (2) payments the following month to bring your balance up to date. Should you miss two consecutive monthly payments (after the 5-day grace period), your trip will automatically be canceled. You will be subject to the refund policies stated in these terms. You may reinstate your trip within 6 days of cancellation by bringing your account up to date.

Bi-weekly payments: LNT allows one missed bi-weekly payment. You will need to make two (2) payments the following week to bring your balance up to date. Should you miss two consecutive bi-weekly payments (after the 5-day grace period), your trip will automatically be canceled. You will be subject to the refund policies stated in these terms. You may reinstate your trip within 6 days of cancellation by bringing your account up to date.

Final Payment

All trip balances must be paid 45 days prior to the trip departure. Reserved trips must be paid in full on or before the final payment date. Any reservations not paid in full on or before a final payment date is subject to a $75 late fee. You will have a 5-day grace period to make your final payment. After the grace period, your trip will automatically be canceled and no refund of payments will be made.

Refund & Cancellation Policy

All guests have 48 hours from the time of booking to cancel a trip for a full refund. After the 48-hour booking period, all trip deposits are non-refundable.

Any cancellation of a booking by a guest must be delivered to LNT in writing and be acknowledged by LNT in writing. For an abundance of clarity and to avoid any miscommunication, we will not consider a reservation canceled until we receive an email from you. In the unfortunate circumstance that you need to cancel your trip, based on the date you notify us by email of the cancellation, we will refund the balance, less the following fees per trip:

Please note: All refunds are subject to a 3% processing fee.

Trips canceled on or after the trip departure, no-shows, leaving the trip early, or unused trip portions will not receive any refund. Additionally, if you did not obtain the required documents (passport, visa, vaccination, insurance, etc) in time for departure, you will not receive any refund.

Although we require travel insurance to ensure you are protected in the event of a medical or family emergency we highly suggest you opt for the “cancel for any reason” coverage, specifically. Should you need to recover any of your non-refundable expenses, you can file a claim with your travel insurance.

LNT reserves the right to cancel or postpone a trip for any reason. If a trip, tour, or experience is canceled prior to departure, on LNT’s behalf, we will provide guests with a full refund of monies paid (minus processing fees); except in the event that the cancellation is due to a significant event that makes it infeasible to operate. Or a future credit towards another trip.

If unforeseen circumstances require a change to the trip itinerary, LNT will make every effort to select alternative hotels of the same standard and to keep modifications of the itinerary to a minimum. If LNT modifies travel dates or the tour itinerary due to circumstances beyond its control that result in your inability to travel on the modified travel dates, you will be issued a credit to use toward an alternate tour of your choice with LNT. If the alternate tour you choose exceeds the value of the trip preferred, the difference in price will be charged to your credit card on the due date unless you make alternate payment arrangements with us prior to the due date.

Covid Trip Cancellations

If your trip is postponed, on behalf of LNT, due to travel restrictions or COVID safety concerns, you will be given the opportunity to book a future tour or receive a future travel voucher for 100% of the money you’ve paid.

Should you need to cancel your trip due to COVID illness or a family emergency we do require travel insurance for protection. However, most insurance policies do not cover cancellations based on fear of travel.

Guest Responsibility​

You have certain responsibilities to LuxNomad Travels and to other LNT guests. You are responsible for understanding the conditions stated in the trip itinerary and selecting an experience in consultation with LNT that is appropriate to your interests and abilities, and for preparing for the trip by reading the LNT tour itinerary provided to you.

LuxNomad Travels has a strict punctuality policy. You agree to arrive on time for the trip and all trip-related activities. uests who do not report to a scheduled activity at the time given will need to find their own transportation to the activity at their own expense.

Conduct

You must at all times strictly comply with all applicable laws and regulations of all countries and regions. You further agree to follow all written and verbal rules of safety presented to you by LuxNomad Travels and the independent contractors it employs. You understand and agree that LNT reserves the right to refuse you as a tour participant, or remove you from any tour, without refund or liability, if it judges you to be incapable of meeting the rigors and requirements of participating in the activities, due to illness or otherwise, or due to any illegal, abusive or disrespectful behavior, or for any other reason it deems necessary and appropriate.

No reimbursements, discounts, or refunds will be issued for services that are missed or unused due to no fault of the LuxNomad Travels including your removal from a tour because of your negligence or breach of these Terms.

Documentation

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure, and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits, and certificates (including but not limited to vaccination or medical certificates) and insurance policies. You must have a passport that is valid 6 months after the last date of travel with LNT has set out on your itinerary. You accept full responsibility for obtaining all such documents, visas, and permits prior to the start of the tour, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by LNT that is a direct result of your failure to secure or be in possession of proper travel documentation. We are not responsible for any errors or omissions given to us by guests.

Medical & Special Needs

You must provide any medical information reasonably requested by LuxNomad Travels and may be required to complete a medical questionnaire or other related forms prior to the tour. LNT has the right to disqualify you at any time during the tour if it believes you are physically or mentally unable to participate in the tour or if your continued participation may jeopardize any other individuals in the tour group. Refunds are not given under such circumstances. You agree to complete the medical questionnaires and any related forms honestly and to disclose all relevant medical information accurately and fully.

You acknowledge that hospital facilities are often unavailable, and evacuation can be prolonged, difficult, and expensive. You also acknowledge that medical facilities abroad may not be of the same standard and quality of service as medical facilities in the United States or your home country.

You further acknowledge that such travel may be dangerous and involve the risk of injury, sickness, or possibly death, as well as damage to property. You acknowledge that you may be traveling to very primitive areas, with a high risk of violence due to crime, war, terrorism, political unrest, and other dangers, and may be exposed to various diseases (food, water-borne, or otherwise).

Travel Documentation

Photo and Video Release

Photography and video of the LuxNomad Travels trip are taken throughout the experience and shared publically post-trip. By participating in this trip you are giving LNT, its representatives, and employees the right to use photographs, video, and testimony given by you during any LNT experience. LNT will not disclose your name online or in printed media without additional expressed written consent.

Indemnity and Binding Effect

Without limitation, LuxNomad Travels is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to: acts of God; acts of government; force majeure; acts of war or civil unrest; insurrection or revolt; strikes or other labor activities; criminal or terrorist activities of any kind, or the threat thereof; overbooking or downgrading of accommodations; structural or other defective conditions in hotels or other lodging facilities; mechanical, or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely; hazards associated with travel to foreign countries including undeveloped areas; dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort; dangers incident to recreational activities such as scuba diving, zip lining, snorkeling, paddle boarding, surfing, swimming, kayaking, sailing, canoeing, horseback riding, rafting, whitewater rafting, hiking, bicycling, canyoning/canyoneering, fishing, snowshoeing, cruising, camping, helicopter tours, 4×4 Jeep/ATV tours, snowmobiling activities, hot air ballooning, jetboating, mule riding, dogsledding, cross-country skiing, rock climbing, etc.; sanitation problems; food poisoning; lack of access to or quality of medical care; difficulty in evacuation in case of a medical or other emergency; illness; the adequacy of medical attention if and when provided; epidemics or the threat thereof including, but not limited to, exposure to COVID-19 by any means of transmission, including any mutation or variation of, and the ongoing effects of, Covid-19 or SARs-COV2; epidemics or the threat thereof; or for any other cause beyond the direct control of LNT.

You are voluntarily participating in the experiences with LuxNomad Travels, and as lawful consideration for the agreement to travel with LNT, you hereby understand and accept the risks and uncertainty involved in participating in any tour. You hereby accept and agree to hold harmless and release LNT, its related companies, officers, and employees from any and all suits, actions, losses, damages, claims, or liability for any personal injury, death, property damage, or other loss, accident, delay, inconvenience or irregularity which is occasioned by any negligent acts or omissions of LNT trips related thereto, or otherwise, including negligence of other persons and companies known or unknown, or of the willful or criminal conduct of third parties.

Third-Party Liability

Although LuxNomad Travels takes all suitable care in selecting third-party suppliers, LNT is unable to control third-party suppliers, does not supervise third-party suppliers, and therefore cannot be responsible for their acts or omissions. Any services provided by third-party suppliers related to your booking are subject to terms and conditions imposed by these third-party suppliers.

LuxNomad Travels assumes no responsibility for and cannot be held liable for any claim, personal injury, death, property damage or other loss, accident, delay, inconvenience, irregularity, upset, disappointment, distress, or frustration, whether physical or mental, resulting from the act or omission of any party, other than that of LNT and its employees. LNT is not liable for the acts or omissions, whether negligent or otherwise, of third-party suppliers or any independent contractors.

Binding Arbitration
You agree that if any dispute relating or referring to these Terms, the trip itinerary, or any other literature concerning the trip, or the trip itself cannot otherwise be informally resolved through informal negotiations or mediation, that the dispute shall be resolved exclusively by binding arbitration before one arbitrator located in Indiana. Any party or their representative may appear for the arbitration by telephone or video conference. Each party shall bear its own fees, costs, and expenses and an equal share of any arbitrator and administrative fees; however, the prevailing party shall be entitled to full recovery of all such costs and fees.
Disputes shall be arbitrated on an individual basis, with there being no right or authority for any disputes to be arbitrated on a class action basis or in a purported representative capacity on behalf of the general public, other third-party travel suppliers, or other entities similarly situated. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionably, or formation of these Terms, including but not limited to any claim that all or any part of these Terms is void or voidable. You understand that by agreeing to these Terms, you and LNT are waiving their rights to a jury trial.
